LOVEBIRD STUDIOS LIMITED TERMS AND CONDITIONSThese Terms and Conditions outline the terms under which Lovebird Studios (the “Company”) offers services and grants membership to individuals. These Terms and Conditions apply to all users of Lovebird Studios’ services, including those who become Members or Students. By accessing or using our services, you agree to these Terms and Conditions. If you do not agree, please do not apply for membership or courses.Please review these Terms and Conditions carefully. By becoming a Member or enrolling as a Student, you agree to be bound by these Terms.
DEFINITIONS–
“Course”: Any scheduled, taught class or series of classes.-
“Class”: Any individual period or portion of a Course.-
“Student”: Any person enrolled in a Course.-
“Member”: Any person whose application for Studio Membership has been accepted.-
“Membership”: A subscription to the studio, with benefits and obligations outlined herein.-
“Notice Period”: The required notice period to terminate the Membership. Unless otherwise stated, the default notice period is one calendar month, with termination effective at the end of the minimum membership period.
“Session”: A 4-hour period during which Members can access the studio.-
“Company”: Lovebird Studios Ltd.-
“Studio”: The Company’s studio is located at Pigdown Plantation, Hever, TN87LX].-
“Terms and Conditions”: These terms and conditions.-
“Week”: A period from 00:01 on Monday to 23:59 on the following Sunday.
GENERAL PROVISIONS
References to the singular include the plural, and vice versa. References to any gender include all genders. These Terms and Conditions form part of the Membership and Student Registration Form.The Company may modify these Terms and Conditions at any time. Changes will be communicated via email and/or by posting a notice in the Studio. Continued use of the services after such changes implies acceptance.The current version of our Terms and Conditions can be reviewed at any time by clicking on the “Terms and Conditions” link on our website. It is your responsibility to ensure you are familiar with the latest version.
MEMBERSHIP AND CLAY CLUB DROP IN
Membership commences once registration has been made and only after an applicant has completed an induction session.
– Age Requirement: Members must be 18 years or older.
– Fees: Membership is a rolling contract, with a minimum term of 2 months. Termination requires a 30-day notice. .
– Discounts and Offers: Occasionally, discounts may be offered. After the offer period ends, the contract reverts to the standard rolling contract.
– Fee Increases: The Company may increase Membership fees, with at least 10 working days’ notice provided.
– Glazes can be chosen from our in house glazes. Participants are permitted to use the kiln room to access and apply dip glazes but are not permitted to touch Kiln equipment at any time. A technician should be present at all times.
MEMBERSHIP and DROP IN SESSION BOOKING
– Booking: Membership and drop in bookings are to be made at least 12 hour prior to the session time.
– Cancellations: Cancellations must be made 12 hours in advance to transfer the booking to another session within the same week. Unused sessions cannot be carried over to the following week.
MEMBERSHIP BENEFITSMembership includes:- Access to the shared studio workspace for up to 3 sessions per week.- Personal storage space, (not applicable to drop in sessions). – Use of in house glazes.- On-site technical support.- Opportunities to exhibit and sell work through events.
HOLIDAYS AND MAINTENANCE CLOSURESThe studio closes for 3-4 days during each of our bi-annual Shows (which all members are invited to take part in). The studio also closes during the month of August and between 4-6 days over the Christmas period, between 23rd December and 2nd January access times may vary. The Company reserves the right in its sole and absolute discretion to close the studio for additional periods. We may, with reasonable notice and at our discretion, close our premises for reasonable periods of time to carry out essential maintenance, repairs, refurbishment, or for other reasons outside of our control. We will endeavour to reopen facilities as soon as is reasonably possible in these circumstances. It is at the members discretion to make full use of the membership program.
USE OF FACILITIESMembers’ access sessions are 4-hour periods starting at specific times throughout the week. Unused sessions do not carry over.
– Guests: You may invite guests to view the studio with prior notice. Guests may not use the facilities and may stay for a maximum of 10 minutes.
– Special Requirements: Please inform us of any special requirements before or during your induction.
MATERIALS
– : ovebird Studios provides clay as part of all memberships and courses. We offer professional-grade stoneware and white stoneware clay, charged at £1 per 100 grams for stoneware and £1.05 per 100 grams for white stoneware, based on weight at leatherhard stage. Members are responsible for weighing their finished pieces and recording the weight in the designated book when placing pottery on the drying rack. Members will be billed at the beginning of each month for their clay usage based on recorded weights. Course participants will be charged for clay usage prior to collection of their finished pieces. Drop ins and Private sessions wares will be weighed and charged at the end of the session and payment taken in full.
If you wish to bring in external materials, please seek prior approval from a member of our staff.
–Glazes and firing: self-made glazes require approval before use in the studio. Test-firing may be required. Glazed work must be fired on a bat to prevent damage. Members are liable for any damage caused to the kiln or furniture and will be charged appropriately. Lovebird Studios will try to ensure that experienced and trained staff are the only people who will handle and fire your ceramic work. However, by the very nature of ceramics, especially within a teaching studio, there is always a risk of technical failure, occasional technical errors and breakages for which we cannot be held in any way responsible.
– Recycling Clay: Lovebird Studios is responsible for recycling all clay to ensure efficient use of resources and minimal waste.
TERMINATION OF MEMBERSHIP– Cancellation: Members may cancel their Membership within 14 days of acceptance, provided they have not used the Studio. Written notice must be given 30 days before the contract end date.
– Early Termination: Membership cannot be canceled before the expiry of the 2-month minimum period.
– Company Termination Rights: The Company reserves the right to suspend or terminate Membership if a Member’s conduct is deemed harmful to the Studio, or if there is a breach of these Terms. No refunds will be given in such cases. Non-payment may result in termination, with all outstanding fees becoming immediately due.
COURSES– Fees: Course fees are payable upon acceptance and before the course starts. Payment for any pottery to be fired is taken before the end of the course.
–Delivery: Courses are delivered as scheduled. If a teacher is unavailable, a substitute will be provided. If not, an additional session or a refund will be arranged.
– Non-attendance: No refunds or substitutions for non-attendance. You may offer your place to a friend, who will then be subject to these Terms and Conditions._*Glazes can be chosen from our house glazes. CANCELLATIONS AND REFUNDS
– Courses: Cancellations made more than 14 days in advance can receive full refund minus £15 admin fee. Cancellations made less than 14 days in advance will not be refundable.
– Gift Vouchers: Gift vouchers can be used for any item on the website. Refunds will incur a £25 administration fee.
HEALTH AND SAFETY All members must complete an induction and sign a form confirming understanding and compliance with health and safety guidelines. The Company may suspend or cancel membership for non-compliance. The Company is not responsible for injuries resulting from misuse of the Studio or equipment.
– Cleaning: Members must clean thoroughly after each session, following specific guidelines. Failure to do so may result in a 20% surcharge on the membership fee. Members must be clean and any damage to others work will result in a fee for remaking costs.
KILN USAGEMembers are not permitted to have access to the kilns, a technician will be loading and unloading the kiln at all times. Members may be liable for costs if they cause damage to the kilns, other peoples work or other equipment due to improper use.
– Photography/Videography: The company has the rights to take photos and Videos during course/membership sessions. Should you wish to not be photographed please inform staff before or during sessions. —
